Welcome to Gibbon Adventure. These Terms and Conditions constitute a legally binding agreement between you (the Client) and Gibbon Adventure Sdn Bhd (the Company). By booking any of our tours, you acknowledge that you have read, understood, and agreed to these terms.
Deposit: A 50% deposit of the total tour price is required to secure your booking.
Balance Payment: The remaining 50% must be paid no later than 45 days prior to the tour commencement date.
Late Bookings: For reservations made within 45 days of the tour, 100% full payment is required for immediate confirmation.
Availability: All bookings are subject to availability. A booking is only considered “confirmed” once you receive a formal confirmation invoice from us.
Wildlife Sightings: While our tours focus on iconic species like the Rhino Hornbill and Clouded Leopard, nature is unpredictable. We do not guarantee wildlife sightings and no refunds will be issued for “no-sightings.”
Ethical Conduct: Guests must follow the guide’s instructions regarding distance and behavior around wildlife. We reserve the right to terminate a tour without refund if a guest’s behavior is deemed harmful to the animals or the environment.
Photography: Guests are responsible for their own camera equipment. Gibbon Adventure is not liable for damage to equipment caused by weather, terrain, or wildlife.
Nature of Travel: The client acknowledges that the nature of Bornean travel is adventurous and involves a degree of personal risk (uneven terrain, remote locations, weather changes).
Waiver: By booking, you agree to release Gibbon Adventure Sdn Bhd and its partners from liability for personal injury, loss, or damage to property, except where caused by gross negligence.
Health & Fitness: Guests must be in good health. It is the client’s responsibility to inform us of any pre-existing medical conditions or dietary requirements at the time of booking.
It is a condition of booking that all guests carry comprehensive travel insurance. This must cover personal accident, medical expenses, emergency repatriation, and trip cancellation.
Flexibility: We reserve the right to alter routes, schedules, or accommodations without prior notice due to local circumstances (e.g., weather, river levels, or park closures).
Force Majeure: Gibbon Adventure is not liable for failure to perform obligations caused by events beyond our control, including natural disasters, strikes, or government restrictions.
The client consents to Gibbon Adventure using photographs or videos taken during the tour that may feature the client for promotional purposes (social media, website, brochures).
Note: If you prefer not to be featured, please inform your guide at the start of the trip.
These terms are governed by the laws of Malaysia. Any disputes shall be settled within the jurisdiction of the courts of Sabah.
